class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>El Tribunal de Comer\u00e7 Internacional dels Estats Units (CIT) ha em\u00e8s una ordre que obliga l&#8217;Oficina de Duanes i Protecci\u00f3 Fronterera (CBP) a tornar els aranzels imposats sota la Llei de Poders Econ\u00f2mics d&#8217;Emerg\u00e8ncia Internacional (IEEPA) a tots els importadors de registre.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-12a41922 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"12a41922\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b504136 elementor-widget elementor-widget-text-editor\" data-id=\"b504136\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Aquesta ordre \u00e9s conseq\u00fc\u00e8ncia de la sent\u00e8ncia pr\u00e8via de la Cort Suprema en el cas  <em>Learning Resources, Inc. v. Trump  <\/em>  (20 de febrer de 2026), que va declarar que aquests aranzels eren <strong>il\u00b7legals<\/strong> .<\/p><p>Els detalls m\u00e9s importants s\u00f3n els seg\u00fcents:<\/p><ul><li><strong>Abast universal:<\/strong> A difer\u00e8ncia d&#8217;altres casos, aquesta ordre s&#8217;aplica a <strong>tots els importadors<\/strong> . El tribunal va determinar que tots els importadors de registre les entrades dels quals van estar subjectes a aquests aranzels tenen dret als beneficis de la decisi\u00f3 de la Cort Suprema, sense necessitat de presentar demandes individuals. <\/li><li>El tribunal ha ordenat a la CBP que:<ul><li>Liquidiu totes les entrades que encara no han estat liquidades <strong>sense incloure els aranzels IEEPA<\/strong> .<\/li><li>Reliquideu (torneu a obrir per a reemborsaments) totes les entrades ja liquidades que encara no siguin definitives, restant aquests aranzels.<\/li><\/ul><\/li><\/ul><p><span style=\"color: #ffffff;\">_<\/span><br> Com que el CIT t\u00e9 jurisdicci\u00f3 nacional i la Constituci\u00f3 exigeix <strong>\u200b\u200buniformitat en els aranzels<\/strong> , \u00e9s imperatiu que la decisi\u00f3 s&#8217;apliqui de manera generalitzada per evitar que els importadors que no van demanar quedin exclosos dels beneficis legals.<\/p><p><strong>Recomanaci\u00f3 per a empreses<\/strong><\/p><p>Tot i que l&#8217;ordre \u00e9s \u00e0mplia, els experts suggereixen que si un importador t\u00e9 entrades liquidades que s&#8217;acosten al termini l\u00edmit de 180 dies per presentar una protesta, hauria de <strong>presentar una protesta formal<\/strong> per preservar els seus drets mentre la CBP estableix el proc\u00e9s d&#8217;implementaci\u00f3 de
