Purpose and beneficiaries

The decree seeks to encourage private investment projects through an “Authorization” that allows their immediate implementation without excessive bureaucratic costs. Eligible projects are:

• Investments in the Poles of Development for Well-Being, areas authorized by the Federal Government to concentrate investments in strategic sectors, taking advantage of the capabilities of each region to generate employment and sustainable development.
• Investments equal to or greater than two billion pesos.
• Projects in strategic sectors such as: technology infrastructure, semiconductors, microelectronics, automotive, medical devices, pharmaceuticals, aerospace, energy and chemicals, among others.

The authorization process

• Single Window: All applications and procedures are carried out through the National Digital Investment Window.
• Once the complete application has been submitted, the Authorization must be issued within 30 working days.
• The authorization lasts for one year, renewable up to two times, provided that the project is at least 90% complete.

Resolution of formalities and “Affirmative Ficta”.

• For projects with this Authorization, the federal authorities must resolve their pending procedures within 60 business days.
• For projects that do not have the Authorization, but use the Digital Window, the resolution period is 90 business days. If the authority does not respond within that time, the process will be considered automatically authorized (afirmativa ficta).
