complexity and administrative costs for EU companies, especially SMEs.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-617babe2 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"617babe2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The EC wants to achieve simplification of EU digital rules mainly through:<\/p><ul><li><strong>Consolidation of the legal acts into a single coherent data framework<\/strong> (the Data Act and the GDPR).<\/li><li>Simplification of privacy rules (such as <strong>one-click <em>cookie<\/em> consent<\/strong>).<\/li><li>The implementation of a <strong>Single Entry Point (SEP)<\/strong> for entities to report cyber incidents by reporting &#8220;once and sharing with many&#8221;.<\/li><li><strong>Adapting the AI Act<\/strong> to ensure smooth and <em>innovation-friendly<\/em> implementation by linking the application of high-risk rules to the availability of standards and extending privileges to <strong>small mid-cap companies<\/strong> (SMCs).<\/li><\/ul><p> <\/p><p>The <strong>Digital Simplification Package<\/strong> is formally articulated through <strong>two main legislative procedures<\/strong>:<\/p><ul><li> <strong> Regulation 1: &#8220;Digital Omnibus&#8221; (for Digital and Data <em>Acquisition<\/em> ). <\/strong>This legislative proposal consolidates the pillars of Simplification of Data Legislation and Adjustments to the GDPR\/Cybersecurity.<strong> Name of the Procedure:<\/strong> Proposal for a Regulation of the European Parliament and of the Council amending various regulations and directives (Digital Omnibus).<\/li><li> <strong> Regulation 2: &#8220;Digital Omnibus on AI&#8221;. <\/strong>This is a <strong>separate legislative proposal<\/strong> that focuses solely on the pillar of adjustments to the AI Act. These are <strong>amendments to the AI Act (AI Act) that <\/strong>seek clear and proportionate implementation of the AI Act.<strong> Name of the Procedure:<\/strong> Proposal for a Regulation of the European Parliament and of the Council amending Regulations (EU) 2024\/1689 and (EU) 2018\/1139 as regards simplifying the implementation of harmonized rules on artificial intelligence<strong>(Digital Omnibus on AI<\/strong>). <\/li><\/ul><p><strong><span style=\"color: #ffffff;\">_<\/span><br>Overall, the European Commission is simplifying or adjusting three<\/strong> <strong>regulatory Pillars<\/strong>:<\/p><h5><strong><span style=\"color: #ffffff;\">_<\/span><br>Simplification of Data Legislation<\/strong><\/h5><p>Data Act (Regulation (EU) 2023\/2854).<\/p><p>Consolidates and modernizes the non-personal data framework. The objective is to <strong>create a &#8220;One Data Act&#8221;<\/strong> by merging and repealing four legal instruments (DGA, ODD, FFDR) into one to increase clarity. <\/p><table><tbody><tr><td><p><strong>Area<\/strong><\/p><\/td><td><p><strong>Simplification Measure<\/strong><\/p><\/td><td><p><strong>Implications<\/strong><\/p><\/td><\/tr><tr><td><p><strong>Consolidation of <em>Acquis<\/em><\/strong><\/p><\/td><td><p>It repeals the Free Flow of Non-Personal Data Regulations (FFDR), the Data Governance Act (DGA) and the Open Data Directive (ODD), integrating their essential rules into the <strong>Data Act<\/strong>.<\/p><\/td><td><p>Increases legal clarity and consistency, reducing compliance costs.<\/p><\/td><\/tr><tr><td><p><strong>Data Intermediation Services (DISP)<\/strong><\/p><\/td><td><p>The mandatory notification regime for DISP becomes <strong>voluntary<\/strong> and the legal separation requirement is eliminated (replaced by functional separation).<\/p><\/td><td><p>Promotes growth and lowers market entry barriers for DISPs.<\/p><\/td><\/tr><tr><td><p><strong>B2G Data Exchange<\/strong><\/p><\/td><td><p>It limits and clarifies the scope of business-to-government (B2G) data sharing provisions to <strong>public emergency situations<\/strong> only.<\/p><\/td><td><p>Reduces legal ambiguity and burdens for companies previously subject to &#8220;exceptional need&#8221; requirements.<\/p><\/td><\/tr><tr><td><p><strong>Cloud Services Switching<\/strong><\/p><\/td><td><p>It introduces a more flexible regime for <strong><em>custom-made<\/em> data processing services<\/strong> and for services provided by <strong>SMEs and SMCs<\/strong>, if the contracts were concluded before September 12, 2025.<\/p><\/td><td><p>Smaller suppliers are allowed to include proportionate penalties for early termination in fixed-term contracts.<\/p><\/td><\/tr><tr><td><p><strong>Smart Contracts<\/strong><\/p><\/td><td><p>Specific essential requirements for smart contracts executing data sharing agreements are eliminated (Article 36 of the Data Act).<\/p><\/td><td><p><strong>Reduces regulatory complexity and uncertainty<\/strong> for innovators in <em>blockchain<\/em> and distributed log technology (DLT)-based solutions.<\/p><\/td><\/tr><\/tbody><\/table><p> <\/p><h5><span style=\"color: #ffffff;\">_<\/span><br><strong>Adjustments to GDPR and Cybersecurity Standards<\/strong><\/h5><p>GDPR (Regulation (EU) 2016\/679) and NIS2\/DORA.<\/p><p>Specific modifications to personal data protection and incident reporting. Aims to <strong>reduce compliance complexity and duplicate reporting<\/strong>. Addresses consent fatigue<em>(cookies<\/em>) and centralizes cyber incident reporting (Single Point of Entry).  <\/p><p> <\/p><table><tbody><tr><td><p><strong>Area<\/strong><\/p><\/td><td><p><strong>Simplification Measure<\/strong><\/p><\/td><td><p><strong>Business Implications\/Benefits<\/strong><\/p><\/td><\/tr><tr><td><p><strong><em>Cookie<\/em> Policy<\/strong><\/p><\/td><td><p><em>Cookie<\/em> rules (currently in the ePrivacy Directive) are reformed and <strong>integrated into the GDPR framework<\/strong>. Banners are simplified with <strong>one-click consent<\/strong> options. <\/p><\/td><td><p>Alleviates &#8220;consent fatigue&#8221; and <strong>reduces compliance costs<\/strong>. Introduces a &#8220;white list&#8221; of low-risk purposes that do not require consent. <\/p><\/td><\/tr><tr><td><p><strong>Use of Data for AI<\/strong><\/p><\/td><td><p>It clarifies that the processing of personal data for the development and operation of AI systems and models can be carried out for <strong>legitimate interest<\/strong> under the GDPR. It also allows exceptional processing of special categories of personal data for the <strong>detection and correction of bias<\/strong>. <\/p><\/td><td><p>It provides legal clarity for AI development and fosters reliable and non-discriminatory European AI innovation.<\/p><\/td><\/tr><tr><td><p><strong>Incident Notification<\/strong><\/p><\/td><td><p>A <strong>Single Entry Point (SEP)<\/strong> managed by ENISA is introduced to simultaneously comply with incident reporting obligations.<\/p><\/td><td><p>It promotes the principle of &#8220;inform once, share with many&#8221;, <strong>reducing administrative burden and duplication<\/strong>.<\/p><\/td><\/tr><\/tbody><\/table><h5><span style=\"color: #ffffff;\">_<\/span><br><strong>Amendments to the IA Law<\/strong><\/h5><p>AI Act (Regulation (EU) 2024\/1689).<\/p><p>Amendments aimed at the governance and implementation timelines of the AI Law.
