class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>The European Parliament has asked the EU Court of Justice to assess the compatibility of the EU-Mercosur agreement with the Treaties, a decision that suspends its ratification and opens a period of uncertainty regarding its timing and implementation.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-30b60617 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"30b60617\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The plenary session of the European Parliament has adopted a <strong>resolution to ask the Court of Justice of the European Union for a legal opinion<\/strong> on the compatibility of the EU-Mercosur agreement with the Treaties.  <\/p><p>The proposal passed <strong>by a narrow majority<\/strong>, reflecting the strong political division that exists around the agreement.<\/p><h5><strong><span style=\"color: #ffffff;\">_<\/span><br>What does the intervention of the Court of Justice entail?<\/strong><\/h5><p>With this decision, <strong>the ratification process is suspended<\/strong> until the Court issues its opinion, a procedure that may take more than a year. However, <strong>the court may give it priority<\/strong> if the situation so requires. <\/p><p>If the Court concludes that any part of the agreement is not compatible with the Treaties, changes to its structure or content may be necessary before proceeding with ratification.<\/p><h5><strong><span style=\"color: #ffffff;\">_<\/span><br>Can the agreement be implemented without waiting for the opinion?<\/strong><\/h5><p>This referral to the CJEU <strong>is not a final rejection of the agreement<\/strong>, but a formal request for a legal opinion prior to a formal ratification by the European Parliament.<\/p><p>The <strong>European Commission could provisionally activate <\/strong>the commercial parts of the agreement without waiting for the court&#8217;s ruling or parliamentary ratification, relying on legal mechanisms similar to those used in previous agreements (e.g. with Chile).<\/p><p>However, although legally it is possible for the Commission to propose to implement the agreement on a transitional basis, politically it is highly controversial.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
