The Trump administration had invoked this law to declare <strong>national emergencies<\/strong> due to drug trafficking (affecting Canada, Mexico and China) and persistent trade deficits, imposing &#8220;reciprocal&#8221; tariffs on nearly all trading partners. <\/p><p>The Supreme Court has decided that:<\/p><ul><li><strong>The Constitution grants Congress<\/strong>, not the president, the exclusive power to impose taxes and tariffs.<\/li><li>The term <strong>&#8220;regulate&#8221; does not include the power to tax<\/strong>, and if Congress had wished to delegate that extraordinary power, it would have done so expressly as in other tariff statutes.<\/li><li>The <strong>&#8220;major issues doctrine&#8221;<\/strong> was applied, arguing that because of the enormous economic and political importance of tariffs, the president needs clear and unambiguous congressional authorization.<\/li><\/ul><h5><strong><br>Immediate consequences and implications<\/strong><\/h5><p>The decision invalidates the general 10% tariff imposed on almost everyone, as well as higher specific levies against key partners such as the EU, China, Canada and Mexico. The &#8220;chaos&#8221; of multi-million dollar reimbursements.<\/strong><\/p><p>One of the biggest unknowns is whether the U.S. government will have to pay back the billions of dollars collected illegally.<\/p><ul><li><strong>Who can claim them:<\/strong> It is unclear whether all importers who paid duties under IEEPA will be able to receive refunds.<\/li><li><strong>Economic magnitude:<\/strong> The Treasury has collected an estimated $133 billion from emergency tariffs alone. Some estimates put the potential cost of the refunds at $120 billion, representing approximately 0.5% of U.S. GDP. <\/li><li><strong>Process complexity:<\/strong> Dissenting Judge Brett Kavanaugh called the refund process a <strong>&#8220;mess&#8221; (mess)<\/strong>, noting that many companies have already passed those costs on to consumers, complicating the logic of the refund.<\/li><\/ul><p><strong><span style=\"color: #ffffff;\">_<\/span><br>2. Stability and predictability for businesses<\/strong><\/p><p>The main concern of the private sector is the lack of a stable framework.<\/p><ul><li><strong>Operational uncertainty:<\/strong> Businesses on both sides of the Atlantic depend on <strong>predictability<\/strong> for their investments and operations; the possibility that Trump will find a new legal route soon keeps markets on edge.<\/li><li><strong>Fear of reintroduction:<\/strong> There is a well-founded fear among exporters, such as the German engineering industry, that similar tariffs (such as 15% to the EU) will be reintroduced under other legal instruments in the very near future.<\/li><\/ul><p><strong><span style=\"color: #ffffff;\">_<\/span><br>5. The scope of the &#8220;Doctrine of Major Issues&#8221;.<\/strong><\/p><p>The ruling leaves open the question of how this precedent will affect other executive actions.
