class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>U.S. Customs and Border Protection will launch on April 20, 2026, a new feature designed to streamline duty refunds under IEEPA.  <\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-73180b38 elementor-widget-divider--view-line elementor-widget elementor-widget-divider\" data-id=\"73180b38\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"divider.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-divider\">\n\t\t\t<span class=\"elementor-divider-separator\">\n\t\t\t\t\t\t<\/span>\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-219b568f elementor-widget class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Beginning <strong>April 20, 2026<\/strong>, U.S. Customs and Border Protection (CBP) will launch the first phase of the <strong>CAPE<\/strong> (Consolidation, Administration, and Entry Processing) tool to facilitate the <strong>refund of duties<\/strong> paid under the International Emergency Economic Powers Act (IEEPA).<\/p><p>Here is a simplified guide on who can claim and the steps required to do so:<\/p><p><span style=\"color: #ffffff;\">&#8211;<\/span><\/p><h5><strong>1. Who can apply for reimbursement?<\/strong><\/h5><p>The <strong>Importer of Record (IOR)<\/strong> who made the entry of the goods into the U.S. or the authorized <strong>broker<\/strong> who filed the entries on behalf of that importer is entitled to claim reimbursement.<\/p><ul><li><strong>If you are a Spanish company that exported:<\/strong> Normally, the refund will be received by your U.S. customer (if he was the importer) or by your U.S. subsidiary if it acted as importer.<\/li><li><strong>If you are a company with a U.S. subsidiary:<\/strong> Your subsidiary, as IOR, is the entity that must manage the process.<\/li><\/ul><p><span style=\"color: #ffffff;\">_<\/span><\/p><h5><strong>2. Cases in which a claim can be filed (Phase 1)<\/strong><\/h5><p>In this first phase, only certain types of entries (import operations) are eligible:<\/p><ul><li><strong>Unsettled entries:<\/strong> Those that are still pending administrative closure by customs.<\/li><li><strong>Recently settled entries:<\/strong> Those whose settlement date does not exceed <strong>80 days<\/strong>.<\/li><li><strong>Special statuses:<\/strong> Entries with suspended, extended or under review settlement status, as well as warehouse entries. In these cases, the refund will be validated, but will be issued at the time of final settlement. <\/li><\/ul><p><strong><span style=\"color: #ffffff;\"><br>What is left out of this stage?<\/span> Entries subject to <strong>antidumping or countervailing<\/strong> duties <strong>(AD\/CVD)<\/strong>, those with open protests, <em>drawback<\/em> claims (when those products or their components are exported later) or those whose liquidation is already final (more than 80 days) will not be accepted in this first stage.<\/strong><\/p><h5><strong><span style=\"color: #ffffff;\">_<\/span><br>3. Essential requirements for the company<\/strong><\/h5><p>In order to receive the money, two technical requirements must be met in the U.S. system:<\/p><ul><li><strong>ACE Portal Account:<\/strong> The importing company must have an active account in the <strong>Automated Commercial Environment (ACE)<\/strong> portal, specifically with the sub-account view of &#8220;Importer&#8221;.<\/li><li><strong>ACH Refund Authorization:<\/strong> All refunds will be paid electronically via <strong>Automated Clearing House (ACH)<\/strong>. It is necessary to register a <strong>U.S. bank account<\/strong> in the &#8220;ACH Refund Authorization&#8221; tab of the ACE portal. <\/li><\/ul><p style=\"padding-left: 40px;\"><em>Note for Spanish companies:<\/em> If the subsidiary does not maintain a U.S. bank account, you may designate your <strong>broker<\/strong> as a &#8220;notify party&#8221; on <strong>Form 4811<\/strong> so that the broker can receive the refund on your behalf.<\/p><h5><strong><span style=\"color: #ffffff;\">_<\/span><br>4. Procedure to follow<\/strong><\/h5><p>Once the system is enabled on April 20, the steps are:<\/p><ul><li><strong>Prepare the entry list:<\/strong> Collect the 11-digit entry <em>numbers<\/em> (unique identifiers for each import transaction with U.S. Customs) on which IEEPA duties were paid.<\/li><li><strong>Upload the &#8220;CAPE Statement&#8221;:<\/strong> A <strong>CSV<\/strong> file must be uploaded through the new &#8220;CAPE&#8221; tab in the ACE Portal. Each file can contain up to <strong>9,999 entry numbers<\/strong>, but multiple statements can be uploaded if necessary. <\/li><li><strong>Validation:<\/strong> The ACE system will perform automatic validations to verify that the entry numbers exist and that the applicant is the IOR or authorized broker.<\/li><li><strong>Receipt of payment:<\/strong> Once the declaration is accepted, CBP estimates that refunds (including interest) will generally be issued within <strong>60 to 90 days<\/strong>.<\/li><\/ul><p><br>It is essential that companies <strong>do not attempt to request these refunds through a Post Summary Correction (PSC)<\/strong>, as CBP has expressly prohibited this method for IEEPA tariffs, forcing the exclusive use of the CAPE tool.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section
